Monday May 14th 1855

Boston & Villalonga  }
        vs           }   Asst
T.J. Prevatt & Co.   }
                     Upon the calling of this case in its
order upon the Docket, it appearing to the Court that no
plea had been filed to the declaration in this case, it is
ordered by the Court that the plaintiffs do take judgment
by Default and that the Clerk assess the damages, and the
Clerk having assessed the damages at four hundred & Seventy two
dollars and forty five cents, therefore it is considered and adjudged
by the Court, that the plaintiffs do have and recover of, and
from the said Defendants, the said Sum of four hundred & seventy two
dollars and forty five cents for their Damages on account of
the nonperformance of the premises and the assumpsions in
the plaintiffs declaration mentioned, together with the
further sum of two     dollars and eighty cents
for his costs in and about his suit in this behalf ex-
=pended and the Defendant in mercy &c

Seventy one    dollar and Seventy four cents therefore
it is considered and adjudged by the Court that the
plaintiff do have, and recover of, and from the
Said Defendant the said sum of Seventy one
dollars and Seventy four cents for his damages on
account of the nonperformance of the premises, and
the assumpsions in the plaintiffs declaration
mentioned, and the further sum of three  dollars
and four cents for his costs in and about his
Suit in this behalf expended, and the Defendant
in mercy &c
