Upon the Calling of^cause
in its order upon the docket, it appearing to the
Court that no plea had been filed to the Declaration
in this case, upon motion of Plaintiffs Counsel
it is ordered that the plaintiff do take a Judgment
be Default having assessed the damages
at three hundred and twenty nine dollars and fifty two
cents therefore it is considered
and adjudged by the Court that the plaintiff do
do have and recover of & from the Said Defendant
the said Sum of three hundred and thirty one dollars and
fifty two nine --- cents for his damages on account
of the nonperformance of the premises and
assumptions in the plaintiffs declaration mentioned
together with the further Sum of four
dollars & cents for his Costs
in and about his Suit in that behalf
Expended in mercy &c
