Court met pursuant to adjournment

State of Florida }
vs } assault with intent to kill
Mathew B. Hawkins }
And now on this day came as well the
Solicitor of the State of Florida, James M. Baker Esqr,
who prosecutes the pleas of the State in this behalf,
and the Defendant in person and his Attornies Messrs
Edwards & Lancaster, and the said Defendant pleads
not guilty, thereupon came a Jury to wit:
John A. Cellon, Benjamin Rollins, William R. Paisley,
George W. Boston, William B. Wimberly, James M. Stewart
Richard Ward, Saml J. Kennard, George B. Payne, James McGinnis
John G. Pelot, Joseph Whitemen
John Sparkman, James A. Stewart and Elias Earle
were examined as witnesses in behalf of the State,
and the said Jury having heard the evidence and
the arguments of Counsel, and the charge of the
Court, retired out of Court to consider of their
verdict and after remaining out for a considerable
length of time, returned into Court and anounced
to the Court that they could not agree upon their
by consent consent of parties
verdict, was^discharged from the further consideration
of the case.
The Grand Jury came into Court and presented
