                   On motion Defendants counsel this indictment
was quashed and Defendant recognised to appear at the
next term of this court.

      vs          }  Carrying arms Secretly

                   And now this day came as well the Solicitor
of the State of Florida James M. Baker Esqr who prosecutes
the pleas of the State in this behalf and the Defendant in
in person, and the said Defendant pleads guilty,
and with the consent of the Solicitor Submitted his case
to the Court, thereupon the Court Sentenced the Defendant
to pay to the State of Florida, the fine of five dollars
together with the costs of this prosicution, and the said
Defendant to Stand committed until the said fine and
costs was paid

                  And now on this day came as well
the Solicitor of the State of Florida James M.
Baker Esqr, who prosicutes the pleas of the
State in this behalf, and the Defendant in
person, and the said Defendant pleads not guilty
thereupon came a to wit S.P. Bevill, P. Dell,
G.W. Boston, Wm Garlin, C. Rain, I.J. Carter,
Oliver Bryant, J.C. Boals, G.J. Burnett, Wm D. Clark
Asa Clark, Wade H. Sparkman
                         as a witness 
Isham Peacok was examined^in behalf of the State,
and the Said Jury after hearing the evidence and the
arguments of counsel and the charge of the Court
retired out of court to consider of their verdict and after
remaining out for a considerable length of time returned
into Court and anounced to the Court that they
could not agree upon their verdict Said Jury
