And now on this day came the parties
by their respective Attorneys, and the defendant
saying nothing in bar or preclusion of the plain-
tiffs said action hereof had against him, It is or-
dered by the Court that the plaintiff do have
his judgment against the said defendant, by
default for want of a plea, and that the
Clerk assess the damages: Whereupon the Clerk
having assessed the damages at Seventy nine
Dollars and ---- cents, it is further ordered
considered and adjudged by the Court that
the plaintiff do have and recover of and
from the said defendant the said sum of
Seventy nine Dollars and -------- cents for his
damages, together with his costs in this behalf
expended, taxed at Six Dollars and ten
cents, and the defendant in mercy &c

And now on this day came the
plaintiff by his attorney, and the defendant
being solemnly called answered not; Whereupon
It is ordered court that the plaintiff do have his
judgment against the defendant by default, for
want of a plea, and that the Clerk do assess
the damages, The Clerk having assessed the
damages at One hundred & five Dollars and sixty eight
cents, it is further ordered, considered and
adjudged by the Court, that the plaintiff do
have and recover of and from the said de-
fendant the said sum of One hundred & five Dollars
and Sixty eight cents for his damages, together with his
costs in this behalf expended taxed at Five
Dollars and 80 cents, and the defendant
in mercy &c
