The Grand Jury came into Court and presented to wit:

State of Florida  }           and Battery 
      vs          }  Assault with intent to kill
John C. Hately    }
              A True Bill


State of Florida    }
       vs           }  Assault with intent to kill
Thos R. Ellis       }
                          Now on this day comes J.P. Sanderson Esqr.
who prosecutes the pleas of the State in this behalf, and the said De-
fendant Thomas R. Ellis, who, on being arraigned, pleaded not
Guilty to the indictment against him, and for his trial put himself
upon the County, whereupon came a Jury to wit,

   2  Jesse Hagan               8  Josiah Seckinger
   3  James Fennell             9  George Sharp
   4  James Hutson              10 Wm F. Rowan
   5  John Prios                11 Wm Sapp
   6  David Strobles            12 Wm Clark

 who were duly sworn well and truly to try said issue, and
a true verdict to give between the State of Florida and the said
Thomas R. Ellis, according to evidence

George W. Aldrich and John Prios, were sworn to give evidence in
behalf of the prosecution.

After hearing the evidence in the cause, the allegations and arguments
of Counsel and the charge of the Court, the Jury retired to deliberate upon
their verdict, and returned into Court and say they find the Defendant
Guilty of Assault and Battery, and assess his fine at Twenty five Dollars

Adam Keil       }  on Land

                It appearing to the Court that the Plaintiff in this case
did, on the 10th day of December 1850, file his Petition for foreclosure, together
with the Mortgage bearing date the 5th day of November A.D. 1850, and that
the said Defendant admits service, waives process, and consents to the
