  Monday December 10th 1855

Bradford & McLin        }  McLin, Smith & Bradford

       And now on this day came the parties by their
attorneys and the defendant saying nothing in bar or
preclusion of the plaintiff's said action hereof against
him, It is ordered by the Court, that the said plaintiff
do have his judgment against the said defendant
by default for want of a plea, and that the Clerk
do assess the damages: Whereupon the Clerk having
assessed the damages at Seventy four  dollars and
forty one cents, It is further ordered considered &c by the Court that
that the said plaintiff do have and recover of and from
the said defendant, the said sum of Seventy four
dollars and forty one cents for his damages, with his costs
in this behalf expended taxed at Four ~~~~ dollars and
thirty five cents, and the defendant in mercy &c

the said plaintiff do have his judgment against
the said defendant by default, and that the
Clerk do assess the damages, Whereupon It is
further considered the Clerk having assessed the
                      $286.26 
damages at two hundred & eighty six Dollars and twenty six cents
It is further ordered, considered and adjudged by
the Court that the said plaintiff do have and recover
of and from the said defendant, the said sum
of two hundred & Eighty six Dollars and twenty six cents
for his damages, together with his costs in this
behalf expended, taxed at three ----------- Dollars
and 78 cents, and the defendant in mercy &c
