vs } Indictment for Retailing spiritous Liquours

} James A. Peden for Defendant
And now on this day come John P. Sanderson Esquire who
prosecutes the pleas of the State in this behalf. And the defendant
comes into Court & is represented & defended by James A.
Peden Esquire. Whereupon came a jury to wit: a jury of
the following persons.
E.R. Prevatt Wade H. Sparkman
John B. Cason Josiah Seckinger
R.S. Stoughton William D. Clark
Johnathon Turner Burrell Stokes.
William T. Smith A.E. Geiger
John Wiggins Bryant Smith
Who were sworn well & truly to try the issues joined between the state
of Florida and the said Defendant. And thereupon the following
Witnesses were called on the part of the State. To wit: N.B. Stafford
William D. Eubanks. Charles MacMain, John H. May
& A.E. Geiger on the part of the Defense.
And thereupon after argument of this cause on the part of the
state by said solicitor and of said defendant by
James A. Peden, Esq. and after the charge of his honor
touching said Indictments. The jury having retired
to consider of their verdict returned by A.E. Geiger their
foreman the following verdict into Court. We the
jury find the Defendant not guilty. Whereupon it is
ordered that said defendant go thereof without ***
**(1) The grand Jury so drawn as aforesaid having retired to select a
foreman: returned into court & announced that they had elected Samuel
Geiger to that office. Who was thereupon appointed by the Court foreman of
the Grand Jury and sworn accordingly and the rest of the Grand
Jurors were also duly sworn, and having received the charge of the
Court returned to their room.
