    Monday  December 10th 1855

      vs          }   assumpsit Debt

           And now on this day came the parties 
by their respective attorneys and the defendant say-
ing nothing in bar or preclusion of the plaintiff's 
said action hereof against him, It is ordered by the 
Court that the said plaintiff do have his judg
ment against the said defendant by default for 
want of a plea, and that the Clerk do assess the dam
ages: Whereupon the Clerk having assessed the dam-
ages at One hundred and forty two dollars and 98/100
ninety eight cents, It is further ordered, considered 
and adjudged by the Court that the said plain-
tiff do have and recover of and from the said de-
fendant the Said Sum of One hundred and forty two
dollars and ninety eight cents, together with his costs
in this behalf expended, taxed at four dollars and 
seventy cents ($4.70) and the defendant in mercy &c

by their respective attorneys, and the defendants 
saying nothing in bar or preclusion of the plaintiffs 
said action hereof against him, It is ordered by 
the Court that the plaintiff do have his judgment 
against the said defendant by default, for want 
of a plea, and that the Clerk do assess the damages,
Whereupon the Clerk having assessed the damages at 
Six hundred and Eleven ($611.62) dollars and sixty two cents
It is further ordered considered and adjudged by 
the Court that the said plaintiff do have and recover of 
and from the said defendant the said sum of 
Six hundred and Eleven dollars and Sixty two cents 
$611.62 for his damages, together with his costs in 
this behalf expended taxed at Four dollars and forty cents
($4.40) and the defendant in mercy &c
