    Monday  December 10th 1855

Samuel B. Thompson }   Smith & Bradford 
      vs           }    assumpsit
Samuel W. Burnett &}   
John D.A. Weimer   }   Coker for Weimer
           And now on this day came the parties by 
their respective attorneys, and the defendant saying 
nothing in bar or preclusion of the plaintiff's said 
action hereof against him It is ordered by the 
Court that the said plaintiff do have his judg-
ment against the said defendants, by default for 
want of a plea, and that the Clerk do assess the dam
ages: Whereupon the Clerk having assessed the dam-
ages at Seventy six dollars and six cents, It is ordered
by the Court further ordered considered and adjudged 
by the Court that the said plaintiff do have and recover 
of and from the said defendant the Said Sum 
of Seventy Six dollars and six cents, together with his 
costs in this behalf expended taxed at Four dollars 
and four $4.04/100 and the defendant in mercy &c

came the parties by their Attorneys and the defendants 
saying nothing in bar or preclusion of the plaintiffs 
said action hereof against him, It is ordered by 
the Court that the said plaintiff do have his judg-
ment against the said defendant by default for 
want of a plea, and that the Clerk do assess the 
damages, Whereupon the Clerk having assessed the 
damages at One hundred and forty seven dollars and 
seventy cents ($147.70) It is further ordered, considered 
and adjudged by the Court that the said plaintiff 
do have and recover of and from the said defendants 
the said sum of One hundred and forty seven dollars 
and Seventy cents together with his costs in this behalf 
expended taxed at four dollars and four cents $4.04
and the defendant in mercy &c
