      Monday December 10th 1855
Henry P. King    }    Smith & Bradford

Gregory P. Yale  }
                 On this cause being called and
it appearing that no service had been perfected
on motion of plaintiff's attorney It is ordered
that the Same be dismissed

Harriet C. Secrest         }
Admrx of James F. Secrest  }   Edwards
         vs        use &c  }   Assumpsit
   John Holden             }   Provence   
                    And now on this day came the
parties by their respective Attorneys and the defendant
saying nothing in bar or preclusion of the plaintiff's
said action hereof against him, It is ordered
by the Court that the said plaintiff do have
his judgment against the said defendant by
default for want of a plea, and that the Clerk
do assess the damages, Whereupon the Clerk having
assessed the damages at Two hundred & Eleven dollars
and thirty three cents, It is further ordered considered
and adjudged by the Court that the said plaintiff
do have and recover of and from the said defendant
the said sum of Two hundred & Eleven dollars and thirty
three cents for his damages, together with his costs
in this behalf expended taxed at Six ~~~~ dollars
and twenty cents and the defendant in mercy &c

               And now on this day came the parties by their

the Court that the plaintiff do have his judgment by default
for want of a plea, and that the Clerk do assess the damages
Whereupon the Clerk having assessed the damages at Eight hun-
dred & thirteen dollars and Eighty four cents It is further ordered, con
sidered and adjudged by the Court that the said plaintiff
do have and recover of and from the said defendants the said
sum of Eight hundred & 13 dollars and Eighty four cents for his dam-
ages together with his costs in this behalf expended taxed at
  Four ~~~ dollars and 95 cents and the defendant
in mercy &c
