             Thursday December 13th 1855

               The Court convened pursuant to adjournment
            Present, His Honor W.A. Forward
                                          Judge &c

           vs    }  assumpsit
Joseph Ferguson  }    Smith & Bradford
    And now at this term and on this day came the parties by
their respective attorneys and thereupon came a Jury to wit:
1   James Garner                7   James M. Gieger
2   William E. Stephens         8   Horace Merry
3   John M. Hires               9   David Gillett
4   Mathew B. Hawkins           10  Chas L. Wilson
5   Burrell T. Stokes           11  Juan A. Sistere
6   John Crews Pelot            12  Elias Earle
who being duly sworn well and truly to try the issue joined be-
-tween the parties, and on motion of plaintiff's attorney leave was
granted to withdraw a Juror, and on motion, It is ordered that
this cause be continued until the next Term. Leave granted
to withdraw Deposition in this cause

                On motion of Mr. Dawkins this cause is con-
tinued until the next Term of this Court

   And now on this day came the parties by their respective
attorneys and the said parties having consented and agreed that
the plaintiff do have Judgment against the defendant for the
sum of Four Hundred & Seventy Three Dollars and fifty Two cents
Whereupon It is ordered considered and adjudged that the plaintiff
do have and recover of and from the defendant the said sum
of Four Hundred and Seventy Three Dollars and fifty Two cents
together with his costs in this behalf Expended Taxed at
Twenty --------- Dollars and ten ------------- cents,
and the Said defendant in mercy &c
