                 And now on this day came the plaintiff by
his attorney, and the defendant saying nothing in bar or
preclusion of the plaintiff's said action hereof against him
It is ordered by the Court that the plaintiff do have his
judgment against the said defendant by default
for want of a plea, with stay of execution until the
next term of the Court, and that the Clerk assess the damages,
And the Clerk having assessed the damages at One hundred & fifty four
dollars and nineteen cents, It is therefore considered by the Court that
the said plaintiffs have and recover of and from the said de-
fendant the sum of One hundred & fifty four dollars and nineteen
cents for their damages sustained by the non performance by the said de
fendant of promises & assumptions in the plaintiffs declaration
mentioned, together with the further sum of Two --- dollars
and forty cents for their costs in this behalf sustained,
and the defendant in mercy &c.

           George          And now on this day came the Plain-
tiff by William  H. Means Esq his attorney, and the defendant
saying nothing in bar or preclusion of the plaintiffs action,
it is ordered by the Court that the Plaintiff do have his judg-
ment by default against the said defendant for want of a
plea, with a stay of execution until the next term of this
Court, and that the Clerk assess the damages, and the said Clerk
having assessed the damages at Sixty three ($63) dollars and
fifty    cents. It is therefore considered & adjudged that the
said Plaintiff have and recover of and from the said de-
fendant, the said sum of Sixty three   dollars and
fifty     cents for his damages by him sustained by reason
of the non performance by the said defendant of the premises
and assumptions in the plaintiff's declaration mentioned, to-
gether with the further sum of two (2) dollars and
75 cents for his costs by him in and about his said suit in
this behalf expended, and the defendant in mercy &c
