Saturday, December 15th 1855

Plaintiffs do have and recover of and from the said
defendant, the said sum of Four hundred & Six dollars
and ninety eight cents for their damages by them sustained
by reason of the non performance by the said defend-
ant of certain promises and assumptions in the said
Plaintiffs declaration mentioned, together with the further
sum of Two --- dollars and forty cents for their costs
in this behalf expended and the Defendant in mercy &c

                            And now on this day came
the Plaintiff by his attorney, and the defendant being
three times solemnly called, answered not, but made
default, thereupon, on motion of Plaintiff's Attorney it
is ordered by the Court, that judgment by default be
rendered against the said defendant and in favor of
the Plaintiff, and that the Clerk assess the damages,
Whereupon the Clerk having assessed the Plaintiffs dam-
ages at Sixty Seven dollars and fifty --- cents, it is
considered and adjudged by the Court, that the said
Plaintiff do have and recover of and from the said
defendant the said sum of Sixty Seven dollars
and fifty cents for his damages by him sustained by
reason of the non performance by the said Defendant
of certain promises & assumptions in the Plaintiffs
declaration mentioned, together with the further sum
of Four   dollars and Eighty Five cents for his costs
in this behalf expended, and the defendant in mercy &c
