                       This cause coming on to be heard upon
                           & the said Demurrer being sustained 
the demurrer to Plaintiffs declaration^it is ordered that the
Plaintiff have leave to amend his declaration by striking
out the word "Trespass".

                          Now on this day came the said
Plaintiff by his attorneys and moved the Court for a judgment
nisi, whereupon on Motion of C.A. Mitchell Esq attorney for
Isaac J. Carter it is ordered by the Court that leave be granted
to substitute the said Carter as defendant in this cause
and that he enter unto the consent rule and plead
