And now on this day came the plain-
tiff by his Attorney and the defendant being three
tines solemnly called answered not, but made
default, thereupon, on motion of plaintiff's attorney
It is ordered by the Court that judgment by de-
fault be rendered against the Said defendant and
in favor of the said plaintiff, and that the
Clerk asses the damages: Whereupon the Clerk
having assessed the damages at Seventy one dollars
and Sixty cents, It is further ordered consid-
ered and adjudged by the Court that the said plain-
tiff do have and recover of and from the said defen-
dant the Said Sum of Seventy one --- dollars
and Sixty cents for his damages, together with
his Costs in this behalf expended taxed at Four
dollars and thirty three cents, and the defendant
in mercy &c
