    Monday May 12th A.D. 1856

Samuel Loman       } Dawkins
        And now on this day came the parties by their respective
attorneys and issue being joined thereupon came a Jury to wit
1   Hezekiah Bushell                  7   Robt K. Hines
2   William O. Clegg                  8   Philip Dell
3   P. Henry Young                    9   Elias Earle
4   David W. Mizell                   10  Henry Moore
5   Maxey D. Colson                   11  Wm T. Malphurs
6   Franklin Cox                      12  David Lynn
who being duly sworn well and truly to try the issue joined be-
tween the parties, after hearing the Testimony of Witnesses, the arguments
of Counsel and the Charge of the Court, retired to consider of their
verdict and thereafter to wit upon the same day said Jury returned
into Court and rendered the following, to wit, We the Jury find for
the plaintiff and assess his damages at four Hundred and seventeen
Dollars and Ninety four Cents" Whereupon It is ordered, considered
and adjudged by the Court, That the plaintiff do have and recover
of and from the defendant the said sum of Four Hundred and
Seventeen Dollars and Ninety four cents, together with his costs in
this behalf Expended Taxed at Seven ------------ Dollars and
twenty ------- cents and the defendant in mercy &c

John G. Rawls            }  Smith & Bradford
           On motion of plaintiffs attorney It is ordered by the
Court that this cause be dismissed at plaintiffs costs.

John C. Boals            }   Bernard
     On motion of Defendant's Attorney It is ordered by the
Court that the defendant do have his Judgment by default against
the plaintiff in this cause for want of a replication.
On the 13th on motion of Plaintiffs attorney, default opened
to file replication: Pleas withdrawn and judg-
ment by consent for Plaintiff for One hundred
and forty nine Dollars and thirty seven cents
together with his costs in this behalf expended taxed
at five Dollars & twelve cents, & the defendant in mercy &c
