           Monday May 12th 1856
adjudged by the Court that the plaintiff do have and recover
of and from the defendant the said sum of Three Hundred and
forty nine Dollars and twenty four cents together with his costs
in this behalf Expended Taxed at Six --- Dollars and
twenty ---- cents and the defendant in mercy &c

         And now on this day came the plaintiff by his attorney
and on motion this cause is ordered to be discontinued

                  And now on this day the parties by their respective
attorneys and on motion of plaintiffs attorney It is ordered that the
plaintiff do have his Judgment against the defendant by default for
want of a plea and that the Clerk do assess the damages Whereupon
the Clerk having assessed the damages at Ninety four ------
Dollars and seventy five cents It is further ordered considered
and adjudged by the Court that the plaintiff do recover of and from
the said defendant the said sum of Ninety four Dollars and
seventy five cents for his Damages together with his costs in
this behalf Expended $3.75 and the defendant in mercy &c

                    And now on this day came the plaintiffs and
defendant by their attorneys and the defendant saying nothing in
bar or preclusion of said plaintiffs said action It is ordered by the court
that said plaintiffs do have their judgment by default against the
defendant, and that the Clerk do assess the damages, Whereupon the Clerk
having assessed the damages at One hundred & ninety Dollars and twenty
     cents It is further ordered considered and adjudged by the Court that
the plaintiff do have and recover of and from the defendant said sum of
one hundred & ninety Dollars and twenty ~~~~~~~~ cents for their dam
