                  Monday May 12th A.D. 1856

No 41.  David W. Mizell Trustee &c }  Edwards & Sanderson
                    & wife -       }

        John H. May -              }  Means S & Bradford & Price
               And now on this day came the parties by their respect
-tive attorneys and Issue being Joined, thereupon came a Jury to wit

3   Daniel Lynn                     9   Wm T. Malphurs
4   Jno B. Standley                 10  Wm O. Clegg   
5   Henry Moore                     11  James Fennell
6   M.D. Colson                     12  Oliver Bryant
who being duly sworn well and truly to try the issue Joined between
the parties, after hearing the Testimony of Witnesses, the argument of
counsel and the charge of the Court, retired to consider of their Verdict
and thereafter and upon the same day said Jurors returned into Court
and rendered the following Verdict to wit: We the Jury do find the
said slaves in said plaintiffs' declaration mentioned to be the proper
-ty of said plaintiffs and do assess their damages at our cost,
Whereupon It is ordered considered and adjudged by the Court that
the plaintiffs do have and retain the possession of the said slaves
in said declaration mentioned, and do have and recover of and
from said defendant said sum of our cost, for their damages together
with their costs in this behalf expended Taxed at

          And now on this day came the plaintiff by his attorney and Sug
gests the death of David Hennis one of the above named defendants and fur-
thur moves the Court for a Judgment by default against John D. Hennis and
George Helveston Whereupon It is ordered by the Court that said plaintiff do
have his Judgment against the defendants in pursuance to his motion and
that the Clerk do assess the damages and the Clerk having assessed the same
at Eight hundred and five Dollars and sixty three
cents It is further ordered considered and adjudged by the Court that the plain
tiff do have and recover of and from said defendants John D. Hennis and
George Helveston said sum of Eight hundred & five  Dollars and
sixty three cents together with his costs in this behalf ex
pended Taxed at six Dollars and seventy five
cents and the defendant in mercy &c
