And now on this day came the parties by their attorneys
and issue being joined thereupon came a Jury to wit

5 Eli N. Adkins 11 David W. Mizelle
6 Daniel Lynn 12 William O. Clegg
who having been empaneled and duly sworn to try the Issue Joined,
between the parties after hearing the Testimony of Witnesses the argument
of Counsel and the charge of the Court retired on charge of a Bailiff
to consider of their verdict and thereupon afterward returned into Court
to wit on the same day, and rendered the following verdict We the
Jury find the defendant Guilty and assess the plaintiffs damages
at Three Hundred Dollars, Whereupon It is ordered, considered and
adjudged by the Court that the plaintiff do have and recover of
and from the said defendant said sum of Three Hundred Dol-
-lars for his damages together with his costs in this behalf expen
ded Taxed at Twenty nine Dollars and thirty --- cents
and the defendant in mercy &c
Whereupon said defendant moved the court in arrest of
said Judgment and for a new Trial upon the grounds in said
motion Stated, and the Court upon argument of said motion
not being advised of its judgment, no further ordered is now made
in the premises.

It is ordered by the Court that all other causes and plaints
standing upon the trial Docket and not herein before mentioned
be continued until the next Term of this Court.

On motion of plaintiff leave is granted to withdraw
the Bond filed as the cause of action in this case upon having
