And now on this day came the
plaintiff by his Attorney and the defendant
being three times solemnly called answered not, but
made default, Whereupon It was ordered by the
Court that the said Plaintiff do have his judgment
by default against the said defendant and that
the Clerk do assess the damages: Whereupon the Clerk
having assessed the damages at Seventy Six Dollars and
twenty five cents It is further Ordered Considered and
adjudged by the Court that the said plaintiff do
have and recover of and from the said defendant
the said sum of Seventy Six dollars and twenty five
cents for his damages, together with his costs in this
behalf expended taxed at Four dollars and
ninety three cents and the defendant in mercy
&c

And now on this day came the parties plaintiff
by their respective his attorneys and on motion It is
ordered by the Court that the plaintiff do have
his judgment against the defendant with stay
of execution until the next term of the Court and
that the Clerk do assess the damages, Whereupon
the Clerk having assessed the damages at Sixty
two Dollars and twenty one cents, It is further
ordered considered and adjudged by the Court
the plaintiff do have and recover of and from
the said defendant the said sum of Sixty two
Dollars and twenty one cents for his damages
together with his costs in this behalf expended
taxed at five Dollars and forty five
cents and the defendant in mercy &c
