                         }
                            And now on his day came the
defendant by James A. Peden Esqire his attorney and exhibited
to the Court here The following stipulation which is in these words
Harrison R. Blanchard    }  
assignee in Bankruptcy of}  Debt in Circuit Court Alachua &
Wyatt C. Allen           }  Levy ----
        vs               }
Simeon Dell              }  A Consent that the order for lean
                         }  to Plaintiff to amend his declar
=ation hitherto granted & obtained in this cause be rescinded
and that Judgment be entered up for defendant and
the demurrer of defendant to Plaintiff declaration as of
the last Term of this Court Nunc Pro Tunc and that said
order be filed in the above stated cause.

                               Ocala April 30th 1850
And moved the Court for Judgment for said defendant in
accordance with said stipulation. Whereupon all and singular
the premises being seen & by the Court here fully understood
and mature deliberation being thereupon had it appears to the
said Court here that the said declaration of the said
Plaintiff is not sufficient in Law Whereupon it is consid-
ered that the said Plaintiff take nothing by his said writ
but that he be in mercy &c. And that the defendant go
thereof without day. And it is further considered by the
Court here that the defendant do recover against the Plaintiff
                   Dollars and                       Cents -
for his Costs & charges by him about his defence in this behalf
paid out & expended by the Court here adjudged to the defendant
** And it is further considered & ordered that this judgment be
entered as of the last Term of this Court Nunc. Pro. Tunc. And it is
done accordingly -----
