                   Monday December 8th  1856

Madison Starke Perry         }
George R. Fairbanks Executors}
of W.W. Geiger deceased      }
           vs                }  Asst
John D. Young and            }
P. Henry Young               }  And now at this day come the
said plaintiffs by Geo R. Fairbanks Esq their attorney and the said
defendants come not but make default (and thereupon the attorney
of the said plaintiffs come not but make default) and there
upon the attorney of the said plaintiff moves for Judgment by
default for want of a plea and that the Clerk assess the
Damages and the Clerk having assessed the damages by reason of
the failure of the said defendants &c at the sum of Five Thousand
Nine Hundred and Eighty five dollars and fifty three cents
                                            Execution as aforesaid 
     Therefore it is considered that the said plaintiffs^do recover
of the said defendants the sum of Five Thousand Nine Hundred and
Eighty five dollars and fifty three cents so in manner and form afore
said assessed against him with interest thereon at the rate of
Six percent until paid and also the sun of Seven--------------
Dollars and fifteen cents for their costs in this behalf Expended

                                 And now on this day came the said Plaintiff
by Rogers & Edwards his attorney, and the said defendant comes not but makes
default, and thereupon the Attorneys of the said Plaintiff moves the Court
for a Judgment by default for want of a plea, and that the Clerk
do assess the damages - And the Clerk having assessed the said
damages at the sum of One hundred and thirty three Dollars and
ninety five cents - it is thereupon considered ordered and adjudged
by the Court that the said Plaintiff do have and recover of and from
the said Defendant the said sum of One hundred and thirty three
Dollars and ninety five cents so in manner and form assessed as aforesaid
against him with interest thereon until paid, as well also as the sum
of Five Dollars and Seventy one cents in this behalf Expended
