Thomas C. Ellis    }  Petition to foreclose Mortgage of Land
      vs           }
Calvin Bryan       }  And now on this day came the Plaintiff by
                   }  his Attorney James A. Peden his attorney and
                   }  presents to the Court here the petition filed
in this cause together with the original Mortgage of said Land
And it being made to appear to the Court that the said petition &
mortgage hath been filed in this Court, On the Twenty fifth day of
March One Thousand Eight hundred & fifty and the service of the ***
filing of said petition & mortgage has been accepted by the said
defendant and that all legal exceptions as to time frame & mode
of service of said notice has been received by said defendant by his endorse-
ment on said notice which is in these words "I accept service
of the motion notice waiving all legal exceptions, as to time & form & mode
of service March 25th 1850"  Calvin Bryan
And the said Plaintiff, having exhibited to this Court, The evidence
of debt to secure which The mortgage whereof foreclosure is sought
in this case was executed which it appears to the court now here
was given by the said defendant above named as Mortgagor
And an affidavit being also made by the said Plaintiff by his
attorney aforesaid Whereby it appears that there is now due &
owing to said Plaintiff the sum of Six hundred and Twelve
dollars for principal & interest that is to say Six hundred dollars
principal and Twelve dollars & fifty cents interest And the
said defendant having by his his written agreement endorsed
on said petition & signed by him. Confessed the cause of
action mentioned & described in said petition for foreclosure
of mortgage and having thereby consented that a decree for
foreclosure be entered of the land described in said petition
and that judgment be entered for the principal & interest
due on the promissory note mentioned therein and
that the interest therein be calculated to the time of entering
the decree. And no obligation being shown or having been filed
to said foreclosure Thereupon on Motion of said Plaintiff
Attorney it is considered by the Court that the said Plaintiff do
recover of the said defendant the sum of Six hundred and
Twelve dollars & fifty cents for the principal & interest due upon
said promissory note to secure which said Mortgage was given
together with six per centum thereon from the date hereof till
paid And also the sum of                                Dollars
and                   Cents for his costs in this
behalf sustained  And it is further ordered & considered
that the said defendants and all persons claiming or to
claim by through or under him shall be forever foreclosed & relieved
of all right equity of redemption of in & to the Mortgaged
property set forth & subscribed in said petition and the said
