        vs                     }    assumpsit
James Burnett & Jno K. Stephens}
                      On this day came the Plaintiff
by John P. Sanderson Esqr his attorney and it
appearing to the Court that no plea had been filed
to the declaration in this case, on motion of plaintiffs
Council it is ordered that the plaintiff do have a
Judgment by default against the Said defendants
for want of a plea and the Clerk do assess the
Damages, and the Said Clerk having assessed the Damages
at the Sum of One hundred & Eighteen dollars and Eleven
cents ($11811) thereupon it is Considered and adjudged by
the Court the Said plaintiff do have and recover of
and from the Said Defendants the Sum of one hundred
                                     for his damages 
and Eighteen Dollars and Eleven Cents ($11811) on account
of the non-performance of the promises and assumpsions
in plaintiffs declaration mentioned and also the Sum
of four dollars and thirty five cents for his costs in and
about his Suit in this behalf expended and the
Defendants in mercy &c

           vs              }
Parsons & Co               }
                    On this day came the parties by their
attorneys and defendants Council moved the Court
for leave to file a plea to the Jurisdiction in this case
and also moved the Court to dismiss this case
for want of Jurisdiction which motions were overruled
by the Court, to which ruling of the Court the defendants
Council excepted

           On this day cane the parties by their attorneys and
defendants Council moved the Court to Dismiss this case for want
of Jurisdiction which motion was over ruled by the Court
to which ruling of the Court the Defendants Council
excepted
