of $5.20 for his costs in and about his suit in this behalf expended
and the Defendant in Mercy &c

                                  On this day came the parties by their 
Attornies, and the Defendant Saying nothing in bar or preclusion of the 
Plaintiffs cause of action, it is ordered that the Plaintiff do have a 
Judgment by nildicit and the Clerk assess the damages, The Clerk 
having assessed the damages at Eighty three 50/100 Dollars ($83.50)  
  Thereupon it is considered and adjudged by the Court that the Plaintiff 
do have and recover of and from the said Defendant the sum of 
Eighty three 50/100 Dollars for his damages on account of the non 
performance by the Defendant of the promises and assumptions in 
the said Plaintiffs Declaration mentioned, together with the sum of
$5 **/100 for his costs in and about his suit in this behalf expended
and the Defendant in mercy &c

& Wife                }    On this day came the Defendants by their
Counsel and the Plaintiff being 3 times Solemnly called, came not
but made default, Whereupon on motion of Defendants Counsel
it is ordered that this case be dismissed at the costs of the Plaintiff
  Thereupon it is considered and adjudged by the Court that the Defen
dent do have and recover of and from the said Plaintiff the Sum of
$          for their costs in and about thier suit in this behalf expended
and the Plaintiff in Mercy & c
