} And now on this day come
the parties by their respective attornies and by agreement
this cause is continued until further order of this
Court and that in the meantime Execution to
which affidavit of illegality has been made by the plaintiff
be stayed & it is done accordingly
John Kitler being in ordered into the presence of this Court
and having been brought before said Court by the Sheriff
and it appearing that the said John Kitler was in a state
of Intoxication & was behaving in a disorderly manner before
this court he was ordered to be confined in the Com-
mon jail of this County by reason of said contempt and
was accordingly committed until tomorrow morning thereto
be brot into this Court.
Henry B. Turner a juror was excused on his appli-
cation by reason of his indisposition from a further
attendance at this Term

and now on this day came the plaintiff
by E.A. Mitchel his attorney and thereupon moves
the court for Judgement by Default for want of a
plea Whereupon Let the Clerk assess the damage of the
said Plaintiff by reason of the premises and the Clerk
Thereupon assessed the Damages at the sum of Sixty
Eight Dollars and cents Therefore it is
considered that the said Plaintiff do recover of the Said
Defendant the Said Sum of Sixty Eight
Dollars and cents so as aforesaid assessed with
Interest at the rate of six percent per annum from
the date thereof till paid and also the further Sum
of Dollars and cents
