                        }      This cause coming on to be heard on the Demurrer
heretofore filed to the Defendants Pleas, on  motion of Plaintiffs counsel it
is ordered that the Plaintiff have leave to withdraw his demurrer to the
first plea and that said plea be set aside, and that the Demurrer to the
second plea be and the same is hereby sustained, Whereupon on motion
of Defendants Counsel it is ordered that the Defendant has leave to amend his
said plea instanter

                       being three times solemnly called               
his attorney and the defendant^came not but made default, Thereupon
on motion of Plaintiffs Counsel it is ordered that the Plaintiff do have a
Judgement by default and the Clerk assess the damages - and the said
Clerk having assessed the damages at Ninety two 40/100 Dollars
Thereupon it is considered and adjudged by the Court that said Plaintiff
do have and recover of and from the said Defendant the sum of Ninety two
40/100 Dollars for his damages on acct of the non performance of the
premises and assumptions in Plaintiffs Declaration mentioned together with the
sum of $     for his costs in and about his suit in this behalf
expended and the Defendant in mercy &c
       And it is agreed by the Plaintiff that no execution do issue
on this Judgement until the next term of the court
