                       Now on this day came the parties and
issue being joined the following Jury was called selected
and sworn to try said Cause to wit, William Sapp Henry
Bouknight, James Pendarvis, Jessee Hague, Giles U. Ellis
Michael McCarrol, Daniel Gillet, George W. Boston Richard
Stokes, Joseph Furgusson, George W. Sanchez and B.D.
White, Whereupon the Plaintiffs counsel after argument
submitted to a Non, Suit, - It is therefore adjudged that
the said Defendant shall have and recover of and
from the said plaintiff, his costs by him in
this behalf expended and the said plaintiff in
mercy &c.
